Registration Terms and Conditions

Substitutions, Changes, Cancellation and Refund Policies

1.

Substitutions and Changes: Substitutions and changes to registration can be made up until 11:59pm EST on September 20, 2010, which is five business days prior to the start of the BlackBerry Developer Conference 2010 ("DEVCON" or "Conference"). Substitutions for individuals registered to attend DEVCON and/or any associated ancillary event (each, a "DEVCON Event", collectively, "DEVCON Events") must be made in writing and sent to the Registrar, defined in section 11(E) below, by e-mail at BlackBerryDEVCON@eventreg.com no later than 11:59pm EST on September 20, 2010. Registrants of DEVCON and/or any DEVCON Events and Companion Pass holders (collectively, "Registrants") cannot "share" a Conference pass.

Cancellations and No-Shows: Cancellations for any DEVCON Event and/or Hotel Bundle must be made in writing and sent to the Registrar by e-mail at BlackBerryDEVCON@eventreg.com no later than 11:59pm EST on September 6, 2010 to receive a refund of the applicable portion of the fee. All Conference cancellations made on or before 11:59pm EST on September 6, 2010, are subject to a cancellation fee of $100.00 USD. There will be no refunds for cancellations received after 11:59pm EST on September 6, 2010. Registrants who have not cancelled on or before 11:59pm EST on September 6, 2010 will be liable for the full applicable registration fee, and must pay any outstanding balance within 30 business days of date of invoice. No Shows: Pre-registered Registrants who do not notify our Registrar by phone or email that they will not attend DEVCON and do not cancel their registration by 11:59pm EST on September 6, 2010 will be liable for the full registration fee and will not receive any refund.

Refund policy only applies to registration fees and Hotel Bundles. Cancellation of travel reservations and hotel reservations that are not part of the Hotel Bundle is the exclusive responsibility of the registrant. RIM and/or Registrar will not be held responsible for any cancellation fees or surcharges, including hotel cancellation fees, for Registrants who have made their own travel arrangements (either with or without the assistance of Registrar).

In case of transmission difficulties or other technical problems related to registration or emailed written notification to the Registrar, please call Registration Services at 866-405-2510 (USA and Canada only)/ + 650-226-0824 (International) or email BlackBerryDEVCON@eventreg.com to notify the Registrar.

The Research In Motion Limited ("RIM") server or designated timekeeper shall be the official timekeeper for the purposes of determining the timing of any registration or notification.

Conference Fees and Deadlines

Passes

(A)

DEVCON Regular Conference Pass:

The DEVCON Regular Conference Pass rate is $1,299.00 USD ("Regular Conference Fee").

DEVCON Regular Conference Pass Holders (each, a "Regular Conference Registrant", collectively, "Regular Conference Registrants") are entitled participate in the following:

  • Keynotes (Monday)
  • Breakout Sessions (Monday - Wednesday)
  • Welcome Reception in the Mobility Pavilion (Monday evening)
  • Conference Party (Tuesday)
  • Hands-on Labs, Ask The Experts, Meet The Experts
  • Mobility Pavilion during open hours (Monday - Wednesday)
  • Breakfast, breaks and lunch (Monday - Thursday)
  • BlackBerry Developer Day (Thursday)
  • Complimentary access to Wi-Fi internet in the conference center
  • Complimentary access to the DEVCON On-Demand Portal*
  • Complimentary registration gift upon check-in onsite

Regular Conference Pass Discounts

Early Bird Discount: Regular Conference Registrants, including Alumni-rate Regular Conference Registrants, who register for DEVCON by 11:59pm EST on August 6, 2010 are eligible to receive a $200.00 USD Early Bird discount off the DEVCON Regular Conference Pass rate.

Note: Early Bird discount will be forfeited if payment in full or an official purchase order document are not received by 11:59pm EST on September 20, 2010.

(B)

Academic Pass:

The Academic pass has two rates; the fee for a Student Conference Pass is $199.00 USD and the fee for a Faculty Conference Pass is $399.00 USD. Academic passes do not qualify for the Early Bird discount or any additional discounts except for the Academic Group Discount Program.

To be eligible for a Student Conference Pass a registrant must be enrolled full time at a post secondary institution and at least 18 years of age.

To be eligible for a Faculty Conference Pass a registrant must be a full time faculty member at an accredited post secondary institution in a relevant program.

Students and Faculty must apply to DEVCON@rim.com with proof of current enrollment or employment which includes current program schedule and/or academic letter from the school and a copy of the school identification card or proof of current employment.

Admittance to the conference as a Student Conference Pass or Faculty Conference Pass holder is subject to the sole discretion of the BlackBerry Developer Conference organizers. Approved Students and Faculty will receive notification via email and given a registration code.

Student Conference Pass holders (each, a "Student Registrant") and Faculty Conference Pass holders (each, a "Faculty Registrant") (Student Participants and Faculty Participants, collectively "Academic Pass Registrants") are entitled to participate in the following:

  • Keynotes (Monday)
  • Breakout Sessions (Monday - Wednesday)
  • Welcome Reception in the Mobility Pavilion (Monday evening)
  • Conference Party Tuesday)
  • Hands-on Labs, Ask The Experts, Meet The Experts
  • Mobility Pavilion during open hours (Monday - Wednesday)
  • Breakfast, breaks and lunch (Monday - Thursday)
  • BlackBerry Developer Day (Thursday)
  • Complimentary access to Wi-Fi internet in the conference center
  • Complimentary access to the DEVCON On-Demand Portal*
  • Other Academic program special events
  • Registration gift upon check-in onsite

To gain admittance onsite at DEVCON as a Student Registrant or Faculty Registrant, fees must be paid in full and copies of all three supporting documents must be provided to DEVCON@RIM.com to receive the conference badge.

  1. Government issued photo identification
  2. Current school ID card
  3. Proof of current enrollment or employment

(C)

Companion Pass:

The companion pass rate is $199.00 USD.

A companion pass can only be purchased by Regular Conference Registrants and Academic Pass Registrants during the registration process or at the Conference. Please note that companions are not permitted to attend Conference keynotes, sessions, labs, or Certification exams. Companion Passes are limited to one Companion Pass per Regular Conference Registrant or Academic Pass Registrant. Companions must be 18 years old or older.

The Companion Pass includes access to the following during the Conference:

- Welcome Reception in the Mobility Pavilion (Monday evening)

- Conference Party

- Breakfast, Breaks and lunch (Monday - Thursday)

- Access to Wi-Fi internet in the conference center

* DEVCON On-Demand Portal

All registrants except for Exhibit only and Companion pass holders will be entitled to access DEVCON On-Demand, an online portal for DEVCON 2010 session content and sponsor information (the "Portal").

The Portal will be accessible until the start of DEVCON 2011, RIM has the right at its sole discretion to restrict access to any content. Registrants' access to the Portal may also be restricted if conference fees are not paid in full by launch of the Portal. The Portal is expected to launch on or about Sunday September 26, 2010.

NOTE: Presentations from BlackBerry Developer Day held Thursday September 30, 2010 will not be included in the Portal.

4.

Add-on Packages

Registration add-on packages are fully refundable subject to the following conditions:

  1. Refunds for add-on packages will be available only to Registrants whose registration is canceled prior to September 6, 2010.
  2. "No-Shows" (Registrants who do not attend but do not cancel their registrations in accordance with the provisions of section 1) are not entitled to refunds for add-ons.
  3. Refunds will not be given if the add-on package has been opened or accessed.
  4. Refunds will not be given after commencement of the BlackBerry Certification Exam.

BlackBerry Certification Exam:

A single BlackBerry Certification Exam fee is $75.00 USD.

The two exam BlackBerry Certified Application Developer bundle fee is $135.00 USD.

NOTE: BlackBerry Certification Exam vouchers purchased for DEVCON are only valid onsite during the DEVCON 2010 conference.

Certification Exams can only be purchased by Regular Conference Registrants and Academic Pass Registrants for personal use during the registration process or onsite during the Conference, subject to availability. In the event a Regular Conference Registrant, Student Registrant or Faculty Registrant cancels his/her DEVCON Conference registration, the Conference organizers will also cancel the Regular Conference Registrant's exam timeslot with Prometric. No-shows, and any exam cancellations made after 11:59pm EST on September 6, 2010, are subject to the full BlackBerry Certification Exam fee.

Certification Exam registrants will receive an email from Registration Services after they complete their registration and purchase the exam to sign-up for an exam timeslot. Exam schedules are managed by a third party company, Prometric.

Discount Programs

(A)

Hotel Bundle - Get 1 night free at the San Francisco Marriott Marquis as part of a 4 night reservation with purchase of a Regular Conference Pass (available only to Regular Conference Registrants) ("Hotel Bundle").

The Hotel Bundle will be available for $794.25 USD including applicable taxes at the time of registration to Regular Conference Registrants. The Hotel Bundle will not be available for comp passes or to holders of any conference pass purchased for under $849.00 (Discounted passes and free passes do not qualify for the Hotel Bundle). The Hotel Bundle requires payment of the Conference registration fee and consists of four (4) nights accommodation at the San Francisco Marriott Marquis. (The savings, based on RIM's special room rate for DEVCON, is $264.75 USD, based on the cost of a three-night stay.)

This offer requires a minimum stay of four (4) consecutive nights at the San Francisco Marriott Marquis, on a room and tax basis. Additional nights and incidentals are the sole responsibility of the Registrant. Upon arrival the Registrant will be required to provide a credit card to cover any incidental charges.

All substitutions, changes, cancellations and refunds of the Hotel Bundle are subject to the terms governing Regular Conference Passes in section 1 above.

(B)

Group Registration Program - Buy 2 passes get 1 free

The DEVCON 2010 Group Registration Program offers three (3) passes for the price of two (2) paid DEVCON Regular Conference Passes (inclusive of applicable Early Bird and Alumni discounts) for Regular Conference Registrants who are employed by the same organization. The Free Pass Registrant must be employed by the same organization as the two Regular Conference Registrants relied upon to obtain the Group Free Pass (defined below).

The DEVCON 2010 Group Registration Program expires 12:00pm PST on September 26, 2010.

The "No Show" policy stated above shall apply to the free pass ("Group Free Pass") obtained under the Group Registration Program. The person registered as the Group Free Pass holder will be subject to the Regular Conference Fee at RIM's sole discretion if the Group Free Pass holder fails to cancel his or her Group Free Pass no later than 12:00pm PST on September 26, 2010. Substitution of the individual registered as a Group Fee Pass Holder is subject to the replacement Group Pass Holder being employed by the same organization as the original group Free Pass Holder, and to the Substitutions and Changes policy above.

To participate in the Group Registrant Program, the person seeking the Group Free Pass must call 866-405-2510 (Toll free - available in USA and Canada only) or +1 650-226-0824 (International) from 9:00am - 9:00pm EST Monday to Friday, or email the Registrar at BlackBerryDEVCON@eventreg.com and provide the first and last names and company names of the two (2) paid Regular Conference Registrants. Registration Services will provide instructions on how to redeem the Group Free Pass. No Regular Conference Registrant may participate in the Group Registration Program more than once.

Note: Sponsor, speaker, press, analyst, complimentary and half-price passes are not eligible for the Group Registration Program.

(C)

Academic Group Program - Buy 2 student passes get 1 faculty pass free

The DEVCON Academic Group Program expires at 12:00pm PST on September 26, 2010.

The DEVCON Academic Group Program offers one (1) free academic pass to a faculty member when two (2) students register at the student rate. All registrants must be from the same institution to qualify for the Academic Group Program.

Academic conference passes must be purchased at the full student rate of $199 US per student in order to be eligible for the Academic Group Program. Other passes, including complimentary and half price passes, do not qualify under the Academic Group Program.

The free pass for the faculty member under the Academic Group Program is subject to the "No Show" policy stated in section 1, above. The Registrant registered under the free pass will be liable for the Faculty Conference Pass fee if the registrant does not cancel his/her pass no later than 12:00pm PST on September 26, 2010.

To participate in the Academic Group Program, the faculty member must call Registration Services at 866-405-2510 (Toll free - available in USA and Canada only) or +1 650-226-0824 (International) from 9:00am - 9:00pm EST Monday to Friday, or email the Registrar at BlackBerryDEVCON@eventreg.com and provide the two (2) student registrants' first and last names and name of the academic institution. Registration Services will provide instructions on how to redeem the free faculty academic pass.

(D)

Alumni Discount

All fee-paying registrants of DEVCON 2009, DEVCON 2008 and/or WES 2010 qualify for the alumni discount for DEVCON 2010 except for those registrants who have outstanding registration fees from DEVCON 2009, DEVCON 2008 and/or WES 2010. For qualified registrants, the alumni discount of $100.00 USD will be deducted from the current registration price by the registration system. To be recognized as alumni, and to be provided with the discount, a registrant must use the same email address he/she used to register for DEVCON 2009, DEVCON 2008 and/or WES 2010. If registrant's email address has changed, the registrant can call Registration Services at 866-405-2510 (Toll free - available in USA and Canada only) or +1 650-226-0824 (International) from 9:00am - 9:00pm EST Monday to Friday, or email BlackBerryDEVCON@eventreg.com to update his/her account and receive the alumni discount. Complimentary passes are not eligible for the alumni discount.

Other DEVCON Terms and Conditions

7.

Program Events and Presentations

(A)

Research In Motion Corporation reserves the right to make any changes to the program in its sole discretion. Every effort will be made to keep presentations and speakers as represented. However, unforeseen circumstances may result in the substitution of one or more presentation topic(s) or speaker(s).

(B)

In the event that the Conference has to be cancelled or changed due to events beyond RIM's control or due to circumstances which are not attributable to wrongful intent or gross negligence of the conference organizers, RIM and the Conference organizers will not be held liable to Registrants for any damages, losses or costs incurred, including but not limited to transportation and accommodation costs. RIM is not liable for changes in program date, content, speakers or venue.

(C)

Also note that while Conference organizers will make their best efforts to distribute copies of presentations to all Regular Conference Registrants and Academic Pass Registrants, some speakers may not want to share their material. Under these circumstances, Conference organizers will respect the wishes of the speakers and withhold copies of their presentations.

8.

Participation

(A)

Research In Motion Corporation reserves the right to restrict participation in DEVCON and all associated ancillary events at its sole discretion.

(B)

For registrants who are public officials or employees of a government department, ministry, agency or government-owned enterprise, you agree that your participation in DEVCON 2010 is for legitimate business purposes related to the activities of your employer or the government department, ministry, agency or government-owned enterprise that you represent, and that you have not been requested by any person and have not offered to provide any business advantage or other benefit for or on behalf of RIM as a condition of your participation in DEVCON 2010. It is expected that you will attend plenary sessions, break-out sessions and other conference events in order to benefit from the curriculum and the opportunity to learn about RIM and its wireless products and solutions.

9.

Release from Liability

(A)

By attending DEVCON 2010, you agree to release and hold RIM, its subsidiaries, affiliates, agents and representatives and each of their officers, directors, agents, representatives and employees (each a "Released Party" and collectively, "Released Parties"), harmless from any and all liability, losses or damages whatsoever for any injuries, losses or damages of any kind, except bodily injury or death to the extent caused by a Released Party, arising from participation in or in connection with DEVCON 2010.

(B)

By agreeing to these Registration Conditions, you release and discharge RIM and its service providers and their respective and their respective parent companies, affiliates, subsidiaries, officers, directors, agents, representatives, and employees from any and all liability, losses or damages resulting from (i) late, lost, delayed, stolen, misdirected, incomplete, unreadable, inaccurate, garbled or unintelligible communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of registration data; and (iv) any printing, typographical, administrative or technological errors in any materials associated with the Conference; or (v) any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Conference.

10.

Consent to Use of Personal Information

By completing and submitting the information requested on the DEVCON Event Registration form to RIM and/or its affiliated companies, you consent to the collection, use, and disclosure of the information by RIM or its service providers on RIM's behalf: i) to administer registration, participation and access to the DEVCON event(s); ii) to contact you after the event(s) for event evaluation purposes and for subsequent event notifications and registrations; (iii) for RIM's internal use, including without limitation, to: (a) understand and meet your needs and preferences, (b) develop new and enhance existing services and product offerings, and (c) manage and develop RIM's business and operations; and (iv) for the purposes set out in RIM's Privacy Policy which can be found at http://www.blackberry.com/legal/privacy.shtml. Except as set out herein, RIM will not disclose your personal information for marketing or other secondary purposes, although RIM may disclose aggregated, non-identifying data relating to the event for marketing or other purposes.

11.

Notifications to Registrants

(A)

RIM collects personal information during the registration process such as name, mailing address, email address and credit card or other payment information in order to collect registration fees and produce entrance badges for Registrants and otherwise administer registration, participation and access to the DEVCON event(s). Independent of RIM's collection of such information, Registrants attending DEVCON may wish to have exhibitors "scan" their entrance badges at the exhibitors' booth to collect their personal information such as name, address, phone number and email.

(B)

Registrants may access the Portal at www.blackberryDEVCON.com (Defined above). By requesting information from third party vendors and sponsors through the Portal, Registrants consent to use of their personal information for the purpose of "follow-up" contact by sponsors, including but not limited to direct mail, phone calls or email messages. Once a Registrant's badge is scanned and/or Registrant provides information to third parties through the Portal, RIM does not have control over what the exhibitor may do with his/her personal information. RIM encourages Registrants to check with individual vendors and exhibitors regarding their specific privacy policies and purposes for collecting Registrants' information when their badge is scanned at a booth. Any decision by Registrant to share personal information with any vendor/exhibitor is the sole responsibility of the Registrant. RIM is not responsible for information provided by Registrants to vendors and/or exhibitors at any DEVCON Event or through the Portal nor is RIM liable for anything done by vendors and/or exhibitors with such information.

(C)

RIM may film, photograph or audio record portions of the event, including lectures and interactions in common areas. These recordings may be archived and used for educational and commercial purposes. By attending, Registrant consents to RIM's global and perpetual use of his or her name, photograph, recorded voice and statements ("Information") in whole or in part, in all media and/or distribution formats, now known and hereafter developed for any lawful purpose, including but not limited to marketing, advertising, publicity, educational, sales, trade, and promotional purposes, with no right of approval and no right to compensation. Registrant releases and discharges RIM from and against any and all claims, damages, costs and/or other liability arising from or relating to use of the Information. RIM shall be the exclusive owner of any and all rights, title and interest, including, without limitation, copyright, electronic and distribution rights, in and to any materials containing the Information created by or on behalf of RIM, in any form.

(D)

Registrants must have reached the age of majority in their respective state, province or territory of residence in order to register for DEVCON.

(E)

RIM reserves the right in its sole discretion to amend these Registration Terms & Conditions to remedy administrative, including without limitation, typographical errors.

RIM is the host of DEVCON.
